Na podstawie art. 18 ust. 2 pkt 15 ustawy z dnia 8 marca 1990 r. o samorządzie gminnym (Dz. U. z 2016 r. poz. 446) oraz art. 6n ust. 1 i 2 ustawy z dnia 13 września 1996 r. o utrzymaniu czystości i porządku w gminach (Dz. U. z 2016 r. poz. 250) Rada Gminy Wierzbno uchwala, co następuje:

§ 1. Określa się wzór deklaracji o wysokości opłaty za gospodarowanie odpadami komunalnymi składanej przez właścicieli nieruchomości zamieszkałych, stanowiący załącznik nr 1 do niniejszej uchwały.

§ 2. Format elektroniczny wzoru deklaracji wskazanej w § 1 oraz układ informacji i powiązań między danymi w deklaracji określony jest w formacie danych XML, stanowiący załącznik nr 2 do niniejszej uchwały.

§ 3. Deklarację o wysokości opłaty za gospodarowanie odpadami komunalnymi, należy składać w terminie 14 dni od dnia zamieszkania na nieruchomości pierwszego mieszkańca. W przypadku zmiany danych będących podstawą ustalenia wysokości należnej opłaty za gospodarowanie odpadami komunalnymi, nową deklarację należy złożyć w Urzędzie Gminy Wierzbno w terminie 14 dni od dnia nastąpienia zmiany.

§ 4. Deklaracje mogą być składane w formie papierowej oraz drogą elektroniczną:

a) deklaracje składane w formie papierowej, należy dostarczyć do siedziby Urzędu Gminy Wierzbno,

b) deklaracje składane drogą elektroniczną, należy składać za pośrednictwem Elektronicznej Platformy Usług Administracji Publicznej (ePUAP) na Elektroniczną Skrzynkę Podawczą Urzędu Gminy Wierzbno. Deklaracja złożona w formie elektronicznej musi być podpisana bezpiecznym podpisem elektronicznym weryfikowanym przy pomocy kwalifikowanego certyfikatu lub podpisem potwierdzonym profilem zaufanym ePUAP.

§ 5. Deklaracje o wysokości opłaty za gospodarowanie odpadami komunalnymi, złożone do dnia wejścia w życie niniejszej uchwały na drukach ustalonych przepisami dotychczas obowiązującymi, zachowują ważność.

§ 6. Traci moc Uchwała Nr XX/87/2013 Rady Gminy w Wierzbnie z dnia 28 stycznia 2013 r. w sprawie wzoru deklaracji o wysokości opłaty za gospodarowanie odpadami komunalnymi zmieniona Uchwałą Nr XXI/94/2013 z dnia 6 marca 2013 r.

§ 7. Wykonanie uchwały powierza się Wójtowi Gminy Wierzbno.

§ 8. Uchwała wchodzi w życie po upływie 14 dni od dnia ogłoszenia w Dzienniku Urzędowym Województwa Mazowieckiego.
